StillFaxing.com is a site that Charles H. Becker runs personally. In these terms, “we” and “us” mean Charles H. Becker. By using the site you agree to these terms and to our Privacy Policy, which is part of them. Sending a fax to a StillFaxing.com number, reporting a fax or blocking your number doesn’t by itself make you agree to these terms.
These terms include binding individual arbitration in Illinois and a class action waiver, which means you give up the right to bring most disputes arising from your use of StillFaxing.com to a judge or jury or to join a group lawsuit over them. They also include an indemnity if your faxes get us held liable or lead to a settlement you approve, set amounts you’ll owe us for faxes that break these terms and lead to a complaint, report, block, claim or inquiry, and attorney’s fees for whoever wins a dispute. You can opt out of arbitration by email within 30 days, as explained in section 18. If you don’t agree, don’t use StillFaxing.com.
1. Who can use it
You must be 18 or the age of majority where you live, whichever is higher, and able to make a binding contract. You can’t use StillFaxing.com if we’ve blocked you or if the law bars you from using it.
Use a real email address that you control. We don’t accept disposable addresses.
There’s a limit on how many free numbers one person can borrow. Don’t try to get around that limit, the bot check or our block on VPNs, proxies and hosting providers.
2. How borrowing works
Enter your email address and we’ll send you a link that works for 30 minutes. Open it, check the box to agree to these terms and the Privacy Policy, and press Start my number. Your time with the number begins then.
A free number lasts 4 hours. You can pay to keep it longer, as explained in section 11.
Faxes that arrive during a short grace period after your time ends may still reach you.
Don’t use StillFaxing.com for emergencies, medical or legal deadlines, or anything where a late or lost fax would cause harm.
3. The numbers belong to us
Every StillFaxing.com number belongs to us and stays ours while you borrow it. Borrowing gives you a temporary, personal permission to send and receive faxes on that number through StillFaxing.com for your borrowing period, which is a few hours, or longer if you pay to extend. You can’t transfer that permission.
You have no rights in the number itself. You can’t port, transfer, sell or share it, publish it as your permanent number or claim it later. Your permission ends when your time ends.
Numbers are recycled. We take commercially reasonable steps to let numbers sit unused for a while between borrowers, but once your time and the short grace period are up, a fax sent to your old number goes to whoever has it then, or to no one, and we can’t stop that. Tell anyone who has the number on file when you’re done with it, and don’t use a number for anything you’ll need to receive after your time ends. If you receive a fax meant for someone else, don’t use it, and delete it.
We may change, swap or retire any number at any time.
4. Your links are your password
There’s no login. Your number’s page and our emails use private links, and anyone who has your number’s link or a fax link can open it. Keep these links private.
You’re responsible for everything done through your links, including any fax sent from your number’s page. We don’t keep a copy of your links, so we can’t recover one you’ve lost, and we aren’t responsible if you forward or leak one.
5. Personal use only
StillFaxing.com is for individuals sending and receiving their own occasional faxes. You can’t use it for commercial or marketing faxing, advertising, broadcast faxing, lead generation, fundraising blasts or running a business’s regular fax line.
We can’t catch every case of misuse. If we don’t act right away, we can still act later, including on past cases.
6. Sending faxes
You’re the sender. You’re legally responsible for each fax you send, for what’s in it and for whether you’re allowed to send it to that number. StillFaxing.com only transmits faxes at your direction.
The cover page. Every fax starts with a StillFaxing.com cover page showing your name, the number you’re sending from, your IP address and a record ID. It also tells the recipient how to stop faxes from StillFaxing.com or report a problem. This applies to every fax, including faxes from paid numbers. Enter your real name and accurate details, and don’t pose as anyone else.
Permission to fax. You promise that you have the recipient’s permission to send them each fax, including our cover page, or that the law otherwise allows you to send it to them.
How much you can send. A free number can send 2 faxes, up to 20 pages in total. Paying to extend adds more. Faxes that fail, get cut off or are cancelled because the recipient blocked us don’t count against your allowance.
Your documents. You can upload a PDF, PNG or JPEG document up to 20 MB. We delete it once the fax finishes, fails or is cancelled, so keep your own copy.
Retries. If a fax doesn’t go through, we retry for a few hours and then mark it failed.
Where you can send. There are some numbers we can’t send to. We also refuse faxes to any number whose owner has asked not to receive faxes from StillFaxing.com, and cancel any already queued.
Our discretion. We may pause sending at any time, and we may refuse, cancel or stop any fax.
7. Receiving faxes
Faxes sent to your number while it’s yours show up on its page, and we email you a link to each one. Received faxes are encrypted shortly after they arrive.
We delete received faxes 7 days after they arrive, so download anything you need. We may label faxes that look like junk. A fax that only partly arrives may be delivered incomplete.
We aren’t responsible for what other people fax to you, and we can’t tell senders that a number has changed hands.
8. What you can’t do
When you use StillFaxing.com, you agree you won’t do any of the following.
- Send unsolicited advertisements, or any fax that breaks the law
- Fax anyone who has asked you to stop, or try to get around a recipient’s block
- Remove, cover or alter the cover page, record ID or opt-out notice
- Commit fraud, phishing or identity theft, impersonate anyone, or send forged documents or prescriptions
- Harass, threaten or stalk anyone
- Send child sexual abuse material or any other illegal content, or material that infringes someone else’s rights or that you have no right to share
- Send malware, overload the service or probe it for weaknesses
- Get around our limits, checks, blocks or allowances, including by using multiple email addresses, VPNs or automation
- Scrape StillFaxing.com or resell it
- Use our numbers to sign up for services in bulk or to get around another service’s verification
- Break any law
9. Your content
You keep your rights in your content. You give us a limited permission to store, process, convert, add a cover page to and transmit it, only to run StillFaxing.com and only for as long as the Privacy Policy says we keep things.
You promise that you have the right to send everything you send.
The site, the StillFaxing.com brand and our code belong to us. You can use the site only as these terms allow.
10. Ads
Ads from Google AdSense pay for our free numbers. We aren’t responsible for advertisers or what they offer. Don’t commit click fraud or abuse the ads.
11. Paying to keep a number longer
You can extend a number from the number’s page while it’s active. Before you pay, we show you the price, the time you’ll get and the fax allowance it adds. Payments are in US dollars and go through Stripe.
Extra time is added to your current end time. No number can be kept more than 30 days from when it started.
We refund you in full automatically if your payment clears after the number has already ended, or if it would push the number past the 30-day limit.
Otherwise, payments are final unless the law requires a refund or we choose to give one. Unused time and fax allowance aren’t refunded and don’t carry over to another number. Any refund of an extension takes back the time it added.
If you dispute a charge with your bank, we may end the number and block you.
Paying doesn’t change section 3.
12. Blocking and ending access
We may block anyone, end any number early, refuse any fax or stop offering StillFaxing.com, at any time, for any reason or no reason, with or without notice.
If we block you, you must stop using StillFaxing.com. You can’t borrow a number or send a fax again, whether with a different email address or through anyone else acting for you. Doing so breaks these terms, and section 17 can apply to any fax sent that way.
If we end a number early because of misuse, you don’t get a refund unless the law requires one. If we end it through no fault of yours, we may refund unused paid time at our discretion.
Sections 3 through 6, 8, 9 and 11 through 20 keep applying after your access ends.
13. Reporting a fax or blocking your number
If you got an unwanted fax through StillFaxing.com, you can report it or block your fax number at the Report a Fax page. Use the record ID printed on the cover page. We’ll confirm by email.
Once your number is blocked, nobody can fax it through StillFaxing.com. We keep blocks and reports indefinitely.
If you send faxes, you agree that the people you fax see your cover page details, that we may share those same details with anyone who reports one of your faxes, and that we may act on reports against you.
14. No guarantees
We provide StillFaxing.com “as is” and “as available.” In plain words, you get the service as it is, with no promises about how well it works.
We don’t promise that any fax goes through, arrives complete or on time, is readable or reaches the right person. We don’t promise that anything stays available for any length of time, that numbers are available or keep working, that they’re free of faxes meant for a past borrower, or that the site is up.
To the extent the law allows, we disclaim all warranties, stated or implied. That includes the warranty of merchantability, which is the legal promise that a product works as you’d normally expect, along with fitness for a particular purpose and non-infringement.
15. Limits on our liability
To the fullest extent the law allows, you use StillFaxing.com at your own risk.
We aren’t liable for indirect, incidental, special, consequential or punitive damages, meaning knock-on losses that follow from a problem. We also aren’t liable for lost profits, data, deals, deadlines or opportunities.
Our total liability to you is capped at the greater of what you paid us in the 12 months before the claim or $20. Except for what this section lets you recover, you release us from liability arising from your use of StillFaxing.com.
Nothing in these terms limits liability that the law doesn’t let us limit, such as liability for fraud or willful misconduct.
16. Covering our costs
You agree to indemnify us and hold us harmless. In plain words, if something you do gets us held liable, you’ll cover it.
This applies when someone brings a claim against us, or a government agency acts against us, and we’re either found liable in a final judgment, arbitration award or decision, or we settle it with your written approval. You’ll repay what we’re ordered or agree to pay, including any fine or penalty, plus the reasonable attorney’s fees and costs we spent defending it, when the claim arises from any of the following.
- Any fax you send, or that’s sent through your number or your links or on your behalf
- Any breach of these terms
- Any breach of the law in using StillFaxing.com
- Any use that exposes us to liability
We’ll tell you about the claim by email once we know about it, and you’ll help us with information you have when we ask.
17. Set amounts for violating faxes
This section sets liquidated damages, which are fixed amounts we agree on now for a kind of harm that’s hard to measure after the fact.
A violating fax causes us real harm. It means handling complaints and reports, damages the number’s reputation and makes it harder to reuse, puts our relationships with phone networks at risk and can call for legal review. The more serious the fallout, the more it costs us. You and we agree that the amounts below are a fair, reasonable pre-estimate of that harm, meant only to compensate us for it.
These amounts apply when both of the following are true.
- A fax you send, or that’s sent through your number or your links or on your behalf, breaks section 8 or is sent after we’ve blocked you
- That fax leads to a complaint, report, block, claim, demand, lawsuit or government inquiry
For each such fax you owe us the highest of these amounts that applies.
- $100 if it leads to a complaint, report or block
- $500 if it leads to a claim, demand, lawsuit or government inquiry
- $500 if it was sent after we blocked you or told you to stop, since those take more of our time to deal with
Attorney’s fees in any dispute over these amounts follow the rule in section 18, so whoever substantially prevails can recover them.
Anything you pay under this section is credited against what you owe under section 16 for the same fax, so we never recover twice for one fax. If these amounts can’t be enforced, we can still recover our actual damages, and section 16 still applies in full.
18. Resolving disputes
This section applies only to disputes arising from your use of StillFaxing.com, which means borrowing a number, sending faxes from it or receiving faxes on it, paying to extend it, and claims under these terms or the Privacy Policy that come from that use. In this section, “dispute” means a dispute this section applies to.
Try to work it out first. If you have a dispute with us, email contact@stillfaxing.com and explain it, and we’ll email you if we have one with you. Section 20 explains how notices by email work. We each get 30 days to resolve it informally before going further.
Binding individual arbitration. If we can’t work it out, you and we agree to resolve the dispute by binding individual arbitration, where a neutral arbitrator decides the case with no judge or jury. The arbitration is held in DuPage County, Illinois, though hearings can happen by phone or video.
Choosing the arbitrator. You and we will agree on a single arbitrator in Illinois. If we can’t agree within 30 days after either of us asks for arbitration, either of us can ask one of the courts listed under Courts below to appoint a neutral arbitrator. The arbitrator decides how the arbitration is run, including filings, the exchange of information and hearings.
Attorney’s fees and costs. In any dispute under these terms, in arbitration or in court, whoever substantially prevails can recover reasonable attorney’s fees and costs from the other side, unless the law says otherwise. If your share of the arbitrator’s fees would be more than it would cost you to file in court, we’ll pay the difference.
Who decides what’s covered. The arbitrator decides questions about the scope of this section and whether a dispute must be arbitrated. A court decides questions about the class action waiver.
Exceptions. Either of us can bring an individual claim in small claims court. Either of us can also ask a court for an injunction, which is an order to stop something, to deal with misuse, unauthorized access or intellectual property infringement.
Class action and jury waiver. You and we each give up the right to a jury trial. Disputes are handled individually only. Neither of us can bring or take part in a class, collective, consolidated or representative proceeding against the other. If a court finds this waiver can’t be enforced for a particular claim, that claim goes to the courts listed below and is never handled as a class arbitration.
Opting out. You can opt out of arbitration within 30 days after you first agree to these terms, which is when you check the box and press Start my number. Reporting a fax or blocking your number doesn’t by itself make you agree to these terms. Email contact@stillfaxing.com from the address you used with us and say you’re opting out of arbitration. Include your name and your number, if you have one. You don’t need to give a reason, and the rest of these terms still apply.
Courts. If you opt out, or if arbitration doesn’t apply to a dispute, the dispute goes only to the state courts in DuPage County, Illinois, or the federal court for the Northern District of Illinois, and you consent to those courts’ jurisdiction.
19. Changes to these terms
We may change these terms. When we do, we’ll update the date at the top, and for big changes we’ll give notice on the site or by email where we can. If you keep using StillFaxing.com after a change, you accept the new terms. A change doesn’t apply to faxes sent or payments made before it takes effect.
Changes to section 18 don’t apply to disputes either of us already knew about before the change. If we make a material change to section 18, you may reject it by emailing contact@stillfaxing.com within 30 days of the change, and the earlier version keeps applying to you.
20. Legal odds and ends
Governing law. Illinois law governs these terms, without regard to its conflict-of-law rules. The Federal Arbitration Act governs section 18.
Entire agreement. These terms and the Privacy Policy are the whole agreement between you and us about StillFaxing.com.
Severability. If any part of these terms can’t be enforced, the rest still applies. If the class action waiver can’t be enforced, section 18 says what happens instead, and that rule overrides this one.
No waiver. If we don’t enforce part of these terms, or enforce it only partly, in one case or against one person, we can still enforce it fully later, in that case or any other. That includes the set amounts in section 17. We only give up a right if we say so in writing, and that covers only what it says.
Assignment. You can’t transfer your rights or duties under these terms. We can transfer ours, including to someone who buys StillFaxing.com.
Events beyond our control. We aren’t responsible for failures caused by things we can’t reasonably control, like network failures, outages or disasters.
Notices. Either of us can give any notice under these terms by email, including notice of a dispute or a demand for arbitration. Anything these terms require in writing can be done by email. We’ll send notices to the email address you used with us, and you send them to contact@stillfaxing.com. A notice counts as given when it’s sent. If you want notices to go to a different email address, contact us and tell us the new one. Until you do, we can keep using the address we have.
Headings. Headings are for convenience and don’t change the meaning of these terms.
21. Contact
Questions about these terms go to contact@stillfaxing.com.
